Terms of Service

1. Agreeing to these terms

By using the Service you agree to these terms. If you use it for a brokerage or another business (an "Organization"), you accept them for that Organization and confirm you're authorized to. If your Organization has signed a separate agreement with RivX, that agreement controls where it differs from these terms.

2. The Service

RivX is customer relationship management software for business-financing brokerages. RivX isn't a lender, a broker or a financial adviser. It doesn't make credit decisions and isn't a party to any financing between an Organization's clients and lenders.

3. Accounts

An Organization's administrators create its users' accounts and choose their roles. Keep your sign-in details to yourself, use two-factor authentication where your Organization requires it, and tell your administrator or us right away if you think someone else has used your account. You're responsible for what happens under your account.

4. Your Organization's data

The information an Organization puts into the Service ("Customer Data") belongs to the Organization. It lets RivX host, process and display Customer Data as needed to provide the Service, as described in our Privacy Policy. The Organization is responsible for having the rights and consents it needs to collect Customer Data and to contact the people in it.

5. Acceptable use

You agree not to:

• break any law that applies to you, including lending, privacy, anti-spam and telemarketing laws;
• send unsolicited bulk or marketing email through the Service or through a Google account connected to it;
• upload malware, or content you don't have the right to share;
• probe, scan or test the Service's security, or try to reach another Organization's data;
• copy, resell or reverse engineer the Service without our written permission;
• use the Service to discriminate unlawfully against an applicant.

6. Connecting your Google account

If you connect your Google account, you authorize RivX to send the emails you write or start in RivX from that account. RivX can't read your mailbox. You can disconnect at any time. Your use of Google remains subject to Google's terms, and section 4 of our Privacy Policy explains what RivX does with Google user data.

7. SuperBroker AI

SuperBroker, RivX's AI assistant, can be wrong. Check its answers before you rely on them; they aren't legal, tax or financial advice. Don't enter Social Security numbers, bank account numbers or card numbers into it. RivX may limit each Organization's monthly use; when the limit is reached, SuperBroker pauses until the next month.

8. Fees

The Organization pays the fees in its order or agreement with RivX.

9. Other services

The Service works with services RivX doesn't control, such as Google, lenders' systems and email providers. Their terms apply to your use of them, and RivX isn't responsible for them.

10. Suspension and ending

We may suspend access to protect the Service or other users, for example after a security incident or a breach of these terms, and we'll tell the Organization when we can. An Organization can stop using the Service at any time under its agreement. When an Organization's account ends, it can ask for an export of its Customer Data within 30 days; after that we delete it as described in our Privacy Policy.

11. Ownership

RivX owns the Service, including its software and design. If you send us feedback, we may use it without any obligation to you.

12. Disclaimers

Except as stated in an Organization's agreement with RivX, the Service is provided "as is" and "as available", without warranties of any kind, to the extent the law allows.

13. Limitation of liability

To the extent the law allows, RivX isn't liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. RivX's total liability for any claim about the Service is limited to the fees the Organization paid RivX in the 12 months before the claim.

14. Changes to these terms

We'll post any change on this page with a new date. If a change is material, we'll tell Organizations before it takes effect. Using the Service after a change takes effect means you accept it.
